Surf Lessons & Equipment Rental
All water-based activities involve inherent risks. The ocean is a dynamic natural environment that may contain hidden hazards, including changing conditions, currents, waves, rocks, marine life, and other dangers. Participants are responsible for familiarising themselves with these risks and exercising reasonable care at all times.
By participating in any surfing or stand-up paddleboarding (SUP) activity, you agree to follow all instructions and safety guidelines provided by the surf lesson provider and its instructors regarding the correct use of surfboards, SUP boards, and related equipment. While the surf lesson provider will take all reasonable precautions to promote participant safety, you confirm that you are physically and mentally fit to take part in recreational water activities, including but not limited to surfing and stand-up paddleboarding.
While using equipment provided by Mike Raven Lda, including surfboards, wetsuits, and rash vests, participants agree to treat all equipment with due care and respect.
To the fullest extent permitted by law, Mike Raven Lda shall not be held liable for any injury, illness, loss, damage, death, expense, or claim suffered by a participant or third party arising from participation in water activities, except where such liability cannot be excluded under applicable law.
Personal accident insurance is included in our surf lessons. However, this insurance may not apply in cases involving negligence, reckless behaviour, misconduct, or failure to follow safety instructions. In such cases, the participant may be held responsible for any costs associated with the repair or replacement of damaged equipment.
The following are considered cases of neglect or misconduct:
- Use of soft boards outside the white water area. Unless instructed by a qualified instructor.
- Use of hard boards in the white water area. Unless instructed by a qualified instructor.
- Walk or sit on the surfboard when upside down (fins faced upward).
- More than one person walking or sitting on the board simultaneously.
- Dragging of surfboard or wetsuit.
- Any damage caused to the equipment intentionally.
- Failure to follow safety procedures and advice given by qualified on duty surf instructors if on lesson.
Kid’s policy
Safety and professionalism are the cornerstones of surf coaching at Soul & Surf. This is even truer when working with kids, we cannot ask our instructors to go beyond what their qualifications and governing bodies advise them to.
- Under 7 — we cannot accept on surf lessons.
- From 7 to 12 — lessons are available if you can demonstrate your child’s swimming ability. Please note however that we require one parent or guardian to be in the water supervising each child at all times since our instructors will have other guests to attend to.
- From 12 – 16 — lessons are available with a parent or guardian supervising at the same beach. The guardian may join the same lesson if they wish.
Bookings
By making a booking, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
You confirm that you are at least 18 years of age and, where a booking is subject to age restrictions, that you and all members of your party meet the applicable age requirements.
You are responsible for ensuring that you have adequate travel and activity insurance covering the activities you intend to undertake, including water sports such as surfing, stand-up paddleboarding, canoeing, and other surf-related activities. We accept no responsibility for any costs, losses, or expenses incurred as a result of your failure to obtain appropriate insurance cover.
Participation in water sports and outdoor activities is subject to weather, sea, and surf conditions, which may be beyond our control. We shall not be liable for any loss, disappointment, expense, injury, or claim arising from unsuitable weather conditions, the unavailability of satisfactory surf, or surf and sea conditions that, in our reasonable opinion, make participation unsafe or impracticable.
We require a 25% non-refundable deposit when making your booking, The rest of your balance can be paid in cash or card before your lesson. If your lesson is within 7 days, the full balance payment is required.
- Bookings made over 7 days: pay 25% deposit
- Bookings made under 7 days: pay 100% full payment
Gift Card
Purchased gift cards are valid for 12 month from the date of purchase and are subject to availability. The gift cards can be redeemed on the website while making an online booking. When making a booking via the online system you can decide the amount to be redeemed, from the full balance. If the amount on the Gift Card is less than the deposit amount, the difference has to be paid first by another payment method. If the Gift Cards are not used in full at once, at checkout the remainder stays valid until the expiry on the same code. Only one Gift Card can be used per booking. After the payment and/or redemption of the Gift Card, the booking is only confirmed if you receive a confirmation email. Gift Cards are non-transferrable. Payments are immediately due when ordering. Payments can be made by credit card. The purchased gift card code can be redeemed after receiving it via email. Gift Cards cannot be exchanged for cash and have no value unless redeemed. Gift Cards are not cheque guarantee, credit, debit or charge cards. Value codes can be shared with third parties after the sale, and hence be redeemed by any third party, but order cancellation is not possible. Cancellation Policy
Since we incur costs in cancelling your lesson, the following cancellation charges will be payable by you:
Cancellation more than 7 days of your lesson – 25% deposit paid
Cancellation within 0-7 days of your lesson – 100% of payment
If you, or any member of your party, wish to cancel a lesson, the person who made the booking must notify us in writing by emailing info@soulandsurf.school.
Change of Date
Booking dates may be changed free of charge up to 72 hours before the start of your confirmed booking. Requests made within 72 hours of the scheduled start time are subject to availability and cannot be guaranteed.
If a requested change cannot be accommodated and you choose to cancel your booking, the cancellation terms and conditions will apply.
Minimum Numbers
Certain lessons, courses, and services advertised on our website are subject to minimum participant numbers and can only operate where there is sufficient demand.
If there are insufficient bookings for a confirmed service, we reserve the right to cancel the arrangement or offer a suitable alternative, such as a private lesson. Should this occur, we will notify you as soon as reasonably possible and no later than 72 hours before the scheduled start time of the service.
You will then have the option to:
- Accept an alternative arrangement of a similar standard; or
- Cancel your booking and receive a full refund of all monies paid to us.
If the alternative arrangement is more expensive than your original booking, you may choose to pay the difference. If you do not wish to accept the alternative offered, you may cancel and receive a full refund.
Where a booking is cancelled due to insufficient participant numbers, no additional compensation, damages, or reimbursement of related expenses (including independently arranged travel, accommodation, or other associated costs) will be payable by us.
Health & Fitness
Some activities require a reasonable level of fitness and physical capability. It is your responsibility to ensure that you, and any member of your party, are fit and able to participate safely. If you are unsure, you should seek medical advice before attending.
We reserve the right to refuse or stop your participation in any activity if, in our reasonable opinion, it would be unsafe or unsuitable for you to take part. We will not be liable for any loss, expense, or compensation arising from such a decision.
You must provide full details at the time of booking of any medical condition, injury, disability, allergy, or other circumstance that may affect your ability to participate safely. You must also inform us promptly of any relevant changes before the activity takes place.
If, in our reasonable opinion, an activity is unsuitable based on any disclosed or subsequently identified medical condition or physical limitation, we may refuse a booking, restrict participation, or cancel the booking. We will not be liable for any resulting loss, expense, or compensation, and cancellation charges may apply in accordance with our cancellation policy.
Your Responsibilities and Behaviour
As part of your booking with us, you are accepting liability for any loss or damage caused by you or any member of your party during the course of your activity. Payment for any loss or damage must be made to us at the time that it occurs or as soon as is reasonably practicable thereafter. If the cost of the loss or damage is not known at the time, we will reasonably estimate it and if this reasonable estimate exceeds the amount paid, you must pay the difference once known, and if it is less, the difference will be refunded to you. You will also be responsible for, and agree to indemnify us, in respect of any claim subsequently made against us and all costs incurred by us (including our own and any other party’s full legal costs) arising from your actions.
You are also responsible for the behaviour of yourself and other members of your party. We can refuse to accept you as a customer or refuse to continue dealing with you and/or any other member of your party by terminating your lesson if yours or their behaviour is or is likely to be, in our reasonable opinion or in the reasonable opinion of our suppliers, disruptive, upsetting or dangerous to yourself or anyone else, or if you or any member of your party have caused or are likely to cause damage to property. In these circumstances, we will not pay any refund, compensation or other sum whatsoever or any costs or expenses incurred by you if we have to terminate your services due to such unacceptable behaviour. In this situation we will have no further responsibility for you or any other member of your party. If your unacceptable behaviour means that you are not able to attend the class, we will treat your booking as cancelled from that moment and you will have to pay the full cancellation charges (the amount of the full lesson).
Complaints
If you wish to make a complaint or claim you must report it to Mike Raven Lda and their representatives immediately, thereby giving them the opportunity to remedy the problem as soon as possible. The company cannot accept any liability whatsoever if they are not informed immediately of a problem. Complaints not resolved completely by ‘the service provider’ in the duration of the lesson should be continued by email within 28 days of the end of the lesson to the service provider to info@soulandsurf.school. And a copy in writing to Quinta das Eiras Velhas, CX1635-E, Almadena, Luz, Lagos 8600-102. ‘The service provider will not accept liability for claims received after this period.
